K65 RGB CUE shows malfunction

just picked up a new k65 RGB and under device on CUE it shows device malfunction, tried every way possible too correct the issue usb 2.0 usb 3.0, all usb ports on the pc, either does not detect the KB at all or shows malfunction.

tried both versions of the CUE software, multiple times! no change, KB working under default profile and leds also working for default, typing with it now so yeah fun! cannot upgrade firmware through CUE and get nothing on profile tab at all cannot even click on it,spent nearly all day yesterday trying to get this too work, about ready to give up and return it, $150 for a keyboard should not be this much of a hassle.
